Before using or subscribing to Ancestry.ca please review the following terms and conditions which define your rights, responsibilities and benefits as a user of Ancestry.ca.

Ancestry.ca Licence and Terms and Conditions of Use

Ancestry.ca is an Internet service (the "Service") owned and operated by Ancestry.com Operations Inc., an American company incorporated in Delaware, USA, and whose registered address is 360 W 4800 N Provo, UT 84604, USA (“Ancestry.com”, “Ancestry”, "we", "our" or "us"). If you are under the age of 18, you may not access nor use this Service, unless you obtain permission of your parent or legal guardian (collectively “Guardian”) and your Guardian has confirmed to us that he or she takes full responsibility for your access and use of this Site. "You" or "your" means a permitted user of the Service or, in the case of minors, the Guardian of such minor. Your use of the Service indicates that you agree to and understand these terms and conditions (the "Terms and Conditions") as well as our PRIVACY POLICY (together the "Agreement"). If you do not agree to be bound by the Agreement, you must not use the Service. We reserve the right to revise the Agreement at any time by updating this posting. You should visit this page periodically to review the current Agreement. Your continued use after any change indicates your acceptance of that change. If you don't want to be bound by a change, you must discontinue use of the Service.

Use of Materials

Ancestry.ca contains graphics, information, data, editorial and other content accessible by any Internet user and similar content which is accessible only to our subscribing members ("Content"). Whether in the free section or in the subscription section of the Service, the copyright in all Content and any other intellectual property rights in the Service are owned by Ancestry, or third party providers, and may be used only in accordance with the provisions of the limited use licence set out below.

Limited Use LICENCE
You are licenced to use the Content only for personal or professional family history research, and may download Content only as search results relevant to that research. You may not use the Content for any other purpose. The download of the whole or material parts of any work or database is prohibited. Resale of a work or database or portion thereof, except as specific results relevant to specific research for an individual, is prohibited. Online or other republication of Content is prohibited except as unique data elements that are part of a unique family history or genealogy. In any permitted republication of Content, reference must be given to Ancestry and any other authors, where applicable. You may not print, use, copy, reproduce, publish or distribute in any manner any of the Content for any other reason without our prior written consent. Any use, copying, reproduction, display, publication, or distribution of the Content not expressly authorized hereunder may violate copyright, trademark and other laws. Violation of this limited use licence may result in immediate termination of your membership and may result in legal action against you. You may use software provided to you in connection with the Service only while online; and you may not download, copy, reuse or distribute that software, except where it is clearly stated in connection with software that it is made available for offline use, and a licence for such use is provided in connection with that software. We reserve the right to prevent your further access to the Service for violating the Agreement.

Certain words, phrases, names, designs or logos used on the site may be protected as trademarks, service marks or trade names of Ancestry or other entities. Nothing contained on this site should be construed as granting any licence or right to use any trademark, logo or design displayed on this site without the express written permission of Ancestry.

User provided content
Portions of the Service will contain user provided content intended to be viewed in the form submitted by a member ("User Provided Content"), to which you may contribute appropriate material. For User Provided Content, Ancestry.ca is merely hosting and providing access. We make no representation or warranty, either express or implied, of any kind with respect to User Provided Content and do not vouch for or warrant the accuracy, completeness or usefulness of any User Provided Content, and are not responsible for the contents of any User Provided Content. Any reliance on User Provided Content will be at your own risk. By submitting material to Ancestry.ca, you grant Ancestry a perpetual, irrevocable licence to use, host and provide access to such material, allow hosting and access on co-branded services to that material, and to use the data contained in that material as search results and to integrate that data into the Service as it deems appropriate. You shall have no claim or other recourse against us for infringement of any proprietary right in User Provided Content. You must submit only material which belongs to you and which will not violate the property or other rights of other people or organizations. We are sensitive to the copyright and other intellectual property rights of others. For more information concerning copyright issues, view our corporate policy.

We reserve the right, but have no obligation, to screen, edit, review, remove or otherwise monitor User Provided Content, with the exception that, to promote privacy, an automated filtering tool will be used to suppress and omit from display information submitted to the user submitted family tree elements of the Service which appears in our best judgment to pertain to a living person. You agree, through your use of the Service, that you will not post any material which is knowingly false and/or invasive of any person’s privacy, defamatory, inaccurate, indecent, abusive, vulgar, hateful, harassing, obscene, pornographic, profane, threatening, offensive, tortuous, or otherwise unlawful or inappropriate or which violates the rights of others. You agree that your postings shall not contain viruses or other contaminating or destructive devices or features. You agree not to post advertisements, chain letters, pyramid schemes, or other forms of commercial or unlawful solicitation. We also reserve the right to act expeditiously to remove or disable access to any User Provided Content that comes to our attention, including information which we believe, in our sole discretion, is knowingly false and/or invasive of any person’s privacy, defamatory, inaccurate, indecent, abusive, vulgar, hateful, harassing, obscene, pornographic, profane, threatening, offensive, tortuous, or otherwise unlawful or inappropriate or which violates the rights of others, and we may terminate your use of the Service in these circumstances.

LIABILITY DISCLAIMER
Although we will try to ensure the accuracy and quality of the Service, the Service is provided on an "as is basis" and (i) we do not accept responsibility for any use of or reliance on the Service or Content or for any disruptions to or delay in the Service; and (ii) we do not make any representations or warranties regarding the accuracy, reliability, comprehensiveness, completeness, timeliness, quality, currency, error-free nature, compatibility, security or fitness for purpose of the Service or Content. The Service may be unavailable at any time. Changes are periodically added to the information herein. No representation, warranty, term or condition, express or implied, of any kind, including representations, warranties or conditions of merchantability or fitness for a particular purpose and non-infringement, is offered by us and our third party suppliers in relation to the Service or Content. Our aggregate liability to our for damages incurred as a direct consequence of our breach of the Agreement shall be limited to the aggregate amounts paid to us under the Agreement in the twelve (12) month period prior to the breach.

NOTWITHSTANDING THE FOREGOING, UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST REVENUE, COMMERCIAL OR ECONOMIC LOSS, LOSS OR CORRUPTION OF, OR DAMAGE TO, DATA, SYSTEMS OR PROGRAMS OR BUSINESS INTERRUPTION) WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE (WHETHER SUCH LOSS OR DAMAGE WAS FORESEEABLE, KNOWN OR OTHERWISE), THAT RESULT FROM THE USE OR INABILITY TO USE THIS SITE OR ITS CONTENTS, OR FOR ANY CONSEQUENCE RESULTING DIRECTLY OR INDIRECTLY FROM ANY ACTION YOU TAKE BASED ON OR MADE IN RELIANCE ON THE CONTENT, USER PROVIDED CONTENT OR ON MATERIALS OR INFORMATION ON OTHER SITES LINKED TO THIS SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Ancestry may, from time to time, provide opportunities to users of the Service to link to or buy services from third parties. Sites of those third parties may be subject to terms and conditions different from those found here. Ancestry makes no representation, warranty or condition concerning, is not responsible for and does not endorse any third party provided goods or services, and you agree that any recourse for dissatisfaction or problems with those goods or services will be sought from the third party provider and not from Ancestry.

If you are dissatisfied with any portion of the Service, or with any of these terms of this Agreement, you should discontinue using the Service.

Additional Guest or Subscribing Member Terms

1. REGISTRATION AND SECURITY

1.1 As part of the registration process, you will select a password and subscriber name ("Username"). You must provide Ancestry with accurate, complete and updated registration information. Failure to do so will result in breach of this Agreement. You understand that you may not (i) select or use a name of another person with the intent to impersonate that person; (ii) use the rights of another person without authorization; or (iii) use a name that we, in our sole discretion, deem offensive. As you submit information, you understand that the network of internet sites including Ancestry.com, Genealogy.com, Ancestry.co.uk, Ancestry.ca, Myfamily.com, RootsWeb.com and FamilyHistory.com (the “Sites”) are owned and operated by Ancestry.com Operations Inc., incorporated in Delaware, USA and the Sites are operated in the United States of America. Registration as a user of the Service or subscriber to any of the Sites will result in your customer information being stored and processed in the United States, and you, in registering or subscribing, specifically consent to that storage and processing, in accordance with our PRIVACY POLICY. You should review and correct this information regularly.

1.2 You must immediately notify us by regular mail or by email at support@ancestry.ca of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or credit card information. You are responsible for maintaining the confidentiality of your password. You will never be required to reveal your password to any representative or agent of Ancestry.ca, its owners or agents.

1.3 You must be 18 years or older to subscribe to the Service.

1.4 You are responsible for all usage or activity on Ancestry.ca via your password account. Distribution of your password to others for access to Ancestry.ca is expressly prohibited and shall constitute a breach of this Agreement. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your account, at our sole discretion, and you may be referred to appropriate law enforcement agencies.

2. FEES AND PAYMENTS

2.1 Continuous Service Membership. Subscription membership in the Service is on a continuous service basis. This means that once you become a subscribing member, your subscription will be automatically renewed, for a subsequent term equal to the length of term of your initial subscription and your credit card will be charged based on the subscription program (annual, monthly, etc.) you have chosen. Credit card charges will be processed within 24 hours after subscription and products included in memberships will be shipped shortly thereafter. You will be notified by email, to the email address you provided, 30 days before your subscription will end. The notification will contain an updated copy of the Agreement and will inform you of any changes to your subscription, including the subscription cost. You will also be asked to correct any personal or contact information which may have changed since your subscription began or your last renewal, as applicable, and you will be advised of the process for canceling your subscription if you choose not to renew. The renewal will be effective the thirty first (31st) day after you receive the notice (the “Renewal Date”). If you wish to terminate your subscription you must notify us at least two (2) days before the Renewal Date by calling (800) 958-9073 Member service is available from Monday to Friday 7:00 am to 4:00 pm MST, or by sending an email to cancel@ancestry.ca providing the following information:

Given name and surname
Username
Subscription type (UK/Ireland collection, etc.)
Email address used when subscribing
Phone number including country code
Country

If you fail to respond to the notice, your subscription will be automatically renewed on the Renewal Date on the same terms and conditions in this Agreement or as amended as set out in the notice.

If you have chosen a monthly subscription, this Agreement constitutes notice that the subscription will automatically be renewed upon the expiry of the first subscription term on the same terms and conditions contained in this Agreement unless you advise us of your intention to terminate your subscription at least two days before the Renewal Date in the manner outlined above. You will be reminded of subsequent renewals according to the process outlined above.

2.2 Cancellations. Initial Annual Subscription. An initial annual subscription comes with the option to cancel during the first 7 working days and receive a full refund, unless the subscription began with a free trial period, in which case the provisions below apply. The 7 working-day period begins on the day you register for the subscription Service, which is also the day you are given access to the subscription area of the Service. If you subscribe to the Service following a free or other trial period, that trial period takes the place of the 7 working day cancellation period, and once the paid subscription begins, no refund will be provided. Cancellations during the 7 working days must be made by calling us at (800)958-9073 (Monday to Friday 7:00 am to 4:00 pm MST) or by sending an email to cancel@ancestry.ca and providing the following information:

Username
Subscription type (Canada Deluxe, etc.)
Email address used when subscribing
Phone number including country code
Country

Your cancellation call or email must be received by end of day (12:00 Midnight MST) on the 7th working day after the subscription begins. Please allow a reasonable time for the refund to reach you or be charged back to your credit card if you have subscribed by credit card. All other subscriptions, including monthly subscriptions, quarterly subscriptions, or annual renewals, may be cancelled by you at any time but no refund will be made for unused subscription periods.

2.3 Subscription costs may be changed by Ancestry.ca at any time and each renewal of your subscription will be at the then standard renewal cost for the period which you originally selected when you subscribed.

3. COMMUNICATIONS BETWEEN ANCESTRY.CA AND YOU

We will send electronic mail to you, for the purpose of informing you of changes or additions to the Content or Service, or of any related products and services that we think may be of interest to you. You may opt out of this notification service by clicking the unsubscribe link at the end of the email. For further information on our use of subscriber demographic information, see the PRIVACY POLICY on the Service.

If you unsubscribe you will still receive email reminders with regard to the renewal of your subscription.

4. TERMINATION

Should you breach this Agreement, we will have the right to revoke your licence to use the Service and suspend your right of access. In such a case, no portion of your subscription payment will be refunded. Should we decide to suspend or terminate the Service for any reason other than breach, we will refund to you the unused portion of your subscription payment, which will be your sole and exclusive remedy upon such a suspension or termination of service.

5. ASSIGNMENT

We reserve the right to assign or transfer our rights and obligations under this Agreement to any person who agrees to assume and comply with all the obligations set out in this Agreement. This Agreement is personal to you and, as a result, you may not without the written consent of Ancestry assign or transfer any of your rights and obligations under this Agreement.

6. MODIFICATIONS TO THIS AGREEMENT AND THE SERVICE

Ancestry has the right, at its sole discretion, to modify this Agreement or the Service at any time in order to take account of changes to the Service, changes in law or any other reason which Ancestry may deem valid at any time. Changes to the Service will be posted at Ancestry.ca or sent via email or postal mail to you. If any portion of this Agreement or any change of this Agreement of the Service is unacceptable to you or will cause you to no longer be in compliance with the Agreement, you may cancel your subscription in accordance with Clause 2. Continued use of the Service now or following posted notices of changes in this Agreement means that you have accepted and are bound by the changes.

7. MISCELLANEOUS

7.1 This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein and any disputes in relation to this Agreement shall be heard by the Courts of the Province of Ontario which shall have non-exclusive jurisdiction with respect thereto.

7.2 In the event that any term of this Agreement or portion thereof is held to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable. We can replace any term which is not valid and enforceable with a term of similar meaning which is valid and enforceable.

7.3 Any failure by us to enforce any term of this Agreement shall not affect our right to require such performance at any subsequent time, nor shall the waiver by us of any breach by you of any provisions of this Agreement be taken to be a waiver of the provision or provisions itself.

7.4 You agree to indemnify us against all liabilities, claims and expenses that may arise from any breach of this Agreement by you or otherwise as a result of your use of Ancestry.ca.
